| General Terms & Conditions for Issuing Cheque Book

الشروط والأحكام العامة لإصدار دفتر الشيكات
|
The customer warrants & confirms to maintain and prevent the cheques from being lost and misused whether by him or by third party. In case the cheques are lost or misused, the customer shall immediately notify the Bank or the competent government authorities to stop payment of the cheques.

يتعهد العميل بالحفاظ على الشيكات من الضياع ومن أي استخدام خاطئ لها منه أو من قبل الغير، وبالقيام في مثل هذه الحالة بإخطار البنك لإيقاف صرفها أو الجهات الحكومية المختصة على الفور.

| The customer declares his knowledge and absolute and final agreement to comply with the instructions of the Central Bank of Kuwait with regard to closing all current accounts belonging to the customer, and listing his name in the Central Survey System, if, within one year, a maximum of three cheques with different numbers issued by him have been returned; or if the Bank sees that the customer acts in bad intentions resulting in failure to honour the cheque. Therefore, the Bank shall close the customer's account immediately after the return of the first or second cheque. The customer's name will continue to be listed in the Central Survey System for a period of one year then his name shall be removed from the system automatically. The customer shall hand over the unused cheques to the Bank as soon as the Bank informs him of closing his account. The customer shall hereby authorize the Bank to open on his behalf another account in his name (without the right to issue cheques on this account) as an alternative to the account that has been closed. The customer shall also authorize the Bank to transfer to the new account, to be opened on his behalf by the Bank, all his obligations due to the Bank, or to third parties recorded on the closed account, such as cash and non-cash credit facilities that have been previously granted to him, including their debit balance. This shall not require the customer’s signature on any other forms or applications or contracts in force at the Bank, given that his approval on the stipulations of this clause shall serve as his final agreement, and a complete discharge for the Bank from any responsibility for any of the actions described hereinabove.

كما يقر العميل بعلمه وموافقته المطلقة والنهائية بالالتزام بتعليمات بنك الكويت المركزي بشأن إقفال كافة الحسابات الجارية للعميل لدى البنك وإدراج اسمه في نظام الحصر المركزي وذلك إذا ارتجعت له خلال سنة شيكات لعدم كفاية الرصيد بحد أقصى ثلاثة شيكات تحمل أرقاماً مختلفة، أو يرى البنك توافر سوء النية لدى العميل بما يترتب عليه عدم صرف الشيك وإقفال الحساب مباشرةً عند ارتجاع الشيك الأول أو الثاني له، على أن يستمر إدراج اسم العميل في النظام لمدة سنة يتم بعدها رفع اسمه من النظام تلقائياً، مع التزامه تسليم الشيكات غير المستخدمة الموجودة في حوزته إلى البنك فور إخطار البنك له بقفل الحساب. ويفوض العميل – بموجب هذا – البنك في القيام نيابة عنه بفتح حساب أخر باسمه (بدون الحق في استصدار شيكات منه)، وذلك بديلاً للحساب الذي تم إقفاله، كما يفوض البنك في نقل كافة التزاماته المقيدة لصالح البنك أو للغير على الحساب المقفل – ومنها التسهيلات الائتمانية النقدية وغير النقدية السابق منحها له ورصيدها المدين لتصبح على الحساب الجديد المزمع فتحه نيابة عن العميل بمعرفة البنك، وذلك كله دون الحاجة إلى توقيعه على أية نماذج أو طلبات أو عقود أخرى معمول بها لدى البنك، حيث أن موافقة العميل على ما جاء في هذا البند تعتبر موافقة نهائية منه وإخلاءً لمسئولية البنك تماما عن أي من هذه الإجراءات الموضحة به.

| The customer acknowledges that the law penalizes the issuer of a cheque with insufficient funds by imprisonment and a fine or any of these two penalties, in accordance with Article (237) of the Kuwait Penal law.

يقر العميل بعلمه بأن القانون يعاقب كل من أصدر شيك ليس له مقابل وفاء قائم وقابل للصرف بالحبس وبغرامة مالية أو بإحدى هاتين العقوبتين، وذلك طبقاُ لأحكام المادة رقم (237) من قانون الجزاء الكويتي.

| The customer acknowledges that he has read & reviewed the list of fees & commissions as applicable by the Bank for issuance of cheques and agrees on the same.

يقر العميل بعلمه وموافقته على لائحة الرسوم والعمولات الخاصة بالبنك لإصدار الشيكات.

| The customer acknowledges that he has reviewed this request and that he understands its content and agrees to its terms & conditions and obligations. He also acknowledges that he received a signed copy of this request.

يقر العميل بالاطلاع على هذا الطلب والعلم بمحتواه وموافقته على ما تضمنه من شروط وأحكام والتزامات، كما يقر أنه قد استلم نسخة موقعة من هذا الطلب.

| Cheque Information Entry Service Terms & Conditions

شروط وأحكام خدمة إدخال بيانات الشيكات
|
| Under this Service, and out of our intention to confirm that the cheques drawn on our account with your Bank have been issued by us as set out and mentioned in this application form "Account", we will enter the cheque's information in the Online Cheque's Information Entry System as applicable in your Bank so that this information will correspond & match the fundamental information contained in the physical cheques presented by the beneficiaries to your Bank for encashment.

بموجب هذه الخدمة، ورغبة منا في تأكيد إصدارنا للشيكات المسحوبة على حسابنا لديكم والمبين في هذا الطلب "الحساب"، سوف نقوم بإدخال بيانات الشيكات على "نظام إدخال بيانات الشيكات المصرفية عبر الإنترنت المعمول به لديكم لتكون مطابقة للبيانات الأساسية الثابتة في الشيكات المقدمة لكم من المستفيدين بغرض صرفها.

| In case any of the cheques's information entered by us under this Service is not matching the information contained in the physical cheques presented to your Bank for encashment, and in the event the information of the cheques is not wholly or partially entered under this Service, please advise us of the same through SMS message or via any of the Bank's electronic channels so that we can respond to your Bank. Notwithstanding the foregoing, your Bank may, in all circumstances and without any responsibility on your part towards us or the beneficiary or third party, encash all cheques drawn on the abovementioned account when all related terms, conditions and required information are met and fulfilled and even in that case where the cheques' related information is not entered by us or the information entered was incomplete or divergent from the information contained in the physical cheques presented to your Bank for encashment.

وفي حال اختلاف أي من بيانات الشيكات المدخلة منا بموجب هذه الخدمة عن تلك الثابتة بالشيكات المعروضة عليكم للصرف، وكذلك في حال عدم الإدخال الكلي أو الجزئي لبيانات الشيكات بموجب هذه الخدمة، فيرجى إخطارنا عن طريق إرسال رسالة نصية أو أي من قنوات الاتصال الإلكترونية المتاحة من البنك حتى نتمكن من الرد عليكم ، وفي جميع الأحوال، وعلى الرغم مما تقدم، يحق لمصرفكم صرف كافة الشيكات المسحوبة على الحساب المذكور متى كانت مكتملة الأركان والبيانات الإلزامية، رغم عدم إدخالنا لبياناتها، أو حتى إذا كانت البيانات المدخلة منا ناقصة أو مختلفة عن تلك المتوفرة في الشيكات المعروضة عليكم للصرف، وذلك كله دون أدني مسئولية عليكم تجاهنا أو تجاه المستفيد أو الغير.

| I acknowledge and undertake that in case a single cheque leaf is lost or stolen from the checquebooks issued on my accounts, I will inform the bank immediately to stop the cheque by submitting an official letter, or a request through the Bank’s Application. I further undertake that the Bank shall not be responsible for processing the checque in the event of delay in informing the Bank through the methods stated hereinabove.

وأقر وأتعهد بأنه في حال فقدان أو سرقة أي ورقة من دفاتر الشيكات الخاصة بحساباتي بأن أقوم بإبلاغ البنك فوراً لإيقاف الشيك، وذلك عن طريق تقديم كتاب رسمي، أو رفع طلب من خلال تطبيق التجاري موبايل. مع إخلاء مسؤولية البنك عن قيامه في تمرير الشيك حال تأخري عن التبليغ بالطرق المذكورة أعلاه.

| In the event that the cheque is submitted through CBK Mobile application, terms and conditions shall apply, which must be reviewed and accepted through the mobile application.

في حال إدخال الشيك عبر تطبيق التجاري موبايل تطبق الشروط والأحكام المتعلقة بذلك والتي يجب الاطلاع عليها وقبولها من خلال تطبيق التجاري موبايل.

| I acknowledge & comply and agree that I have read all terms & conditions related to this Service, understood its content and conclusively accepted the terms & conditions and obligations contained therein. Further, I declare that I have no right to object to such terms & conditions in the future. I also acknowledge that I will always pursue any terms and conditions that may be introduced to this service through the Commercial Bank of Kuwait website, and that I am fully aware of their content and agree on the same.

وأقر والتزم وأوافق بأنني اطلعت على كافة الشروط والأحكام المتعلقة بتلك الخدمة وعلمت بمحتواها ووافقت على ما تضمنته من شروط وأحكام والتزامات على نحو نهائي كما أقر بعدم أحقيتي في الاعتراض عليها مستقبلا. كما أقر بالاطلاع الدائم على أية اشتراطات أو أحكام قد تطرأ على هذه الخدمة من خلال الموقع الإلكتروني للبنك التجاري الكويتي وعلمي بمضمونها وموافقتي على ما يرد بها.
